TERMS AND CONDITIONS

Effective January 2026

1. INTRODUCTION AND ACCEPTANCE

A. These Terms and Conditions (Terms) govern your access to and use of the Ride The World mobile application (App, RTW, or Platform) and all related services provided by RTW APP PTY LTD, ABN 67 693 589 847 (we, us, our, or RTW).

B. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein.

C. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP. Your continued use of the App constitutes acceptance of these Terms as they may be modified from time to time.

D. These Terms incorporate by reference our Privacy Policy, which governs how we collect, use, and protect your information.

2. DEFINITIONS

In these Terms, unless the context otherwise requires:

Account means your user account for accessing the App and its features.

Broadcast System means the peer-to-peer safety messaging feature that allows users to send location-tagged, time-limited alerts.

Content means any text, images, data, information, or other materials posted, transmitted, or shared through the App.

Heat Map means the anonymised, real-time display of rider density and activity visible on the Home Screen.

Mate Network refers informally to the community of riders using RTW, but does not create any obligation, duty of care, or guarantee of assistance between users.

Ride means a motorcycle journey or event created, joined, or coordinated through the App.

RTW Pro means the paid subscription tier offering extended features.

User, you, or your means any person who downloads, installs, accesses, or uses the App.

3. NATURE OF THE SERVICE AND COMMUNITY

3.1 Community-Based Platform

A. RTW is a community-first motorcycle application that uses rider community as the foundation to enable functional tools for ride planning, coordination, communication, and safety-aware situational awareness.

B. RTW is NOT a social media platform. All interactions are contextual, purpose-driven, and peer-to-peer.

C. The Mate Network is an informal term describing the rider community. It does not create, imply, or guarantee any relationship or obligation between users to provide assistance, respond to broadcasts, or render aid.

3.2 Voluntary Participation

A. All user interactions, responses, and assistance are entirely voluntary and at the sole discretion of individual users.

B. RTW does not coordinate, facilitate, guarantee, or endorse any assistance, response, or action taken by users.

C. Users have no duty or obligation to respond to broadcasts, provide assistance, or interact with other users in any way.

4. CRITICAL WARNINGS AND ASSUMPTION OF RISK

4.1 Not an Emergency Service

THE APP IS NOT AN EMERGENCY SERVICE AND MUST NOT BE RELIED UPON AS

SUCH.

A. The Broadcast System does not contact emergency services, police, ambulance, or any official authority.

B. RTW provides no guarantee that any broadcast will be received, viewed, or responded to by other users.

C. In any emergency, you must contact appropriate emergency services immediately (in Australia: Triple Zero 000, elsewhere: your local emergency number). Do not rely on the App for emergency assistance.

D. RTW has no control over whether other users will see, respond to, or act upon any broadcast or message.

4.2 Inherent Risks of Motorcycling

YOU ACKNOWLEDGE THAT MOTORCYCLING IS AN INHERENTLY DANGEROUS

ACTIVITY THAT CARRIES SIGNIFICANT RISK OF SERIOUS INJURY OR DEATH.

A. By using RTW, you acknowledge and accept all risks associated with motorcycling, including but not limited to: collision, loss of control, mechanical failure, road hazards, weather conditions, other road users, and your own riding ability and judgment.

B. You are solely responsible for your own safety, riding decisions, route selection, speed, motorcycle maintenance, protective equipment, insurance, licensing, and compliance with all applicable laws.

C. RTW does not verify, endorse, or guarantee the safety of any route, ride, user, or information shared through the App.

4.3 User Responsibility and Judgment

A. You must exercise your own independent judgment at all times. RTW is a tool for coordination and information sharing only.

B. You must not use the App while operating a motorcycle or any vehicle. Pull over safely before accessing, reading, or sending any information through the App.

C. You are responsible for verifying all information, routes, conditions, and advice received through the App before acting upon it.

D. You acknowledge that information shared by other users may be inaccurate, incomplete, outdated, or misleading. RTW bears no responsibility for user-generated content or advice.

5. APP FEATURES AND DISCLAIMERS

5.1 Rider location pin map

A. The rider location pin Map displays anonymised, periodic rider density and activity for general situational awareness only.

B. When you use the App, your approximate location may be visible to other users through the location Map to show general rider activity in your area.

C. The location pin Map does NOT indicate:

i. whether riders are available to assist;

ii. precise rider locations;

iii. rider identity;

iv. that any rider will respond to broadcasts; or

v. any safety guarantee.

D. Location data may be delayed, inaccurate, or incomplete due to GPS limitations, network connectivity, device settings, or technical issues.

E. RTW makes no warranty regarding the accuracy, reliability, or availability of location data or the Heat Map.

5.2 Broadcast Safety Messaging System

A. The Broadcast System is a peer-to-peer communication tool that allows users to send location-tagged, time-limited alerts about route hazards, mechanical issues, delays, or general safety information.

B. Broadcasts are NOT emergency calls. They do not contact authorities and carry no guarantee of delivery, receipt, viewing, or response.

C. RTW has no control over:

vi. whether broadcasts are received or viewed;

vii. who receives broadcasts;

viii. whether recipients respond;

ix. the accuracy of broadcast content; or

x. actions taken by other users in response.

D. You must not use the Broadcast System for actual emergencies. Always contact emergency services directly.

E. Broadcast range may be limited based on your subscription tier (free vs RTW Pro), network connectivity, and technical factors.

5.3 Ride Planning and Coordination

A. Users may create, join, and manage rides, import routes, and coordinate with other riders through the App.

B. RTW provides tools for coordination only. We do not organise, supervise, endorse, verify, or guarantee the safety of any ride.

C. Ride creators and participants are solely responsible for all aspects of ride planning, safety, conduct, compliance with laws, insurance, and risk management.

D. You acknowledge that participating in group rides carries additional risks, including varying skill levels, group dynamics, and coordination challenges.

E. The App does not provide information on environmental or weather conditions.

5.4 Messaging

A. The App includes direct and group messaging features for ride-related coordination and communication between users.

B. You are solely responsible for all messages you send and all actions you take based on messages you receive.

C. RTW does not monitor, verify, endorse, or take responsibility for the content of user messages.

D. Messages are not encrypted end-to-end. Do not share sensitive personal information through the App.

5.5 Global Connectivity

A. Users may contact other riders domestically or internationally for planning advice or local knowledge.

B. All such interactions are voluntary, user-initiated, and at users' own risk.

C. RTW provides no warranty regarding the accuracy, reliability, or safety of information provided by other users.

D. You acknowledge that riding conditions, laws, customs, and risks vary significantly by location. You are solely responsible for understanding and complying with local requirements.

6. NO DUTY OF CARE OR GUARANTEE OF ASSISTANCE

A. RTW DOES NOT CREATE ANY DUTY OF CARE, OBLIGATION, OR RESPONSIBILITY BETWEEN USERS.

B. No user owes any duty to any other user to:

i. respond to broadcasts or messages;

ii. provide assistance;

iii. verify information;

iv. ensure safety; or

v. take any action whatsoever.

C. The Mate Network term is informal only and creates no legal relationship, obligation, partnership, agency, or guarantee between users.

D. RTW provides a communication platform only. We do not coordinate rescue, assistance, or emergency response of any kind.

E. You release all other users from any claims arising from their decision to respond or not respond to your broadcasts, messages, or requests for assistance.

7. ACCOUNT AND ELIGIBILITY

A. You must be at least 16 years old and hold a valid motorcycle licence to use the App.

B. You must provide accurate, current, and complete information when creating your Account.

C. You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account.

D. You must notify RTW immediately if you suspect unauthorised access to your Account.

E. You may not share, sell, or transfer your Account to any other person.

F. RTW reserves the right to refuse access, suspend, or terminate any Account at any time for any reason, including breach of these Terms.

8. MEMBERSHIP, SUBSCRIPTIONS, AND PAYMENTS

8.1 Membership Tiers

A. RTW operates on a freemium model with two membership tiers:

Free users:

Access to core features including limited broadcast range, basic ride coordination, limited messaging and location Map visibility.

RTW Pro (paid subscription):

Access to extended broadcast range, advanced ride administration tools, global messaging, and additional features.

B. Feature availability and subscription pricing may change. We will provide reasonable notice of material changes.

8.2 Subscription Terms

A. RTW Pro subscriptions are recurring monthly or annual subscriptions charged through the Apple App Store or Google Play Store.

B. Subscriptions automatically renew each month or annually depending on type of subscription unless cancelled before the renewal date.

C. You authorise RTW and the applicable platform (Apple or Google) to charge your payment method for all subscription fees.

D. All fees are in Australian Dollars (AUD) unless otherwise specified.

E. Subscription fees are non-refundable except as required by law or as expressly stated in these Terms.

8.3 Cancellation and Refunds

A. You may cancel your RTW Pro subscription at any time through your Apple App Store or Google Play account settings.

B. Cancellation takes effect at the end of your current billing period. You will retain access to RTW Pro features until that time.

C. No refunds or credits will be provided for partial months, unused features, or early cancellation.

D. Refund requests must comply with Apple or Google's refund policies. RTW does not control platform refund decisions.

E. If we suspend or terminate your Account for breach of these Terms, no refund will be provided.

8.4 Price Changes

A. We may change subscription prices at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

B. If you do not accept a price increase, you may cancel your subscription before the increase takes effect.

9. ACCEPTABLE USE AND PROHIBITED CONDUCT

A. You agree to use the App in a responsible, lawful, and respectful manner. You must not:

xi. Use the App while operating a motorcycle or any vehicle;

xii. Misuse the Broadcast System by sending false, misleading, harassing, or inappropriate alerts;

xiii. Use the Broadcast System for advertising, spam, or non-safety-related purposes;

xiv. Harass, threaten, intimidate, stalk, or harm other users;

xv. Post or share content that is unlawful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable;

xvi. Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

xvii. Violate any applicable laws, regulations, or third-party rights;

xviii. Attempt to gain unauthorised access to the App, other users' Accounts, or RTW's systems;

xix. Reverse engineer, decompile, or disassemble the App;

xx. Use automated means (bots, scrapers, etc.) to access the App;

xxi. Interfere with or disrupt the App's operation or servers;

xxii. Remove, alter, or obscure any proprietary notices or branding;

xxiii. Use the App for any commercial purpose without our prior written consent;

xxiv. Create multiple Accounts or share your Account with others.

10. USER-GENERATED CONTENT

A. You are solely responsible for all Content you post, transmit, or share through the App, including messages, broadcasts, ride descriptions, routes, and any other information or materials.

B. You represent and warrant that you own or have the necessary rights to all Content you submit, and that such Content does not violate these Terms or any third-party rights.

C. By posting Content through the App, you grant RTW a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, display, and distribute such Content in connection with operating and improving the App.

D. RTW does not pre-screen or monitor all Content but reserves the right to review, remove, or modify any Content at any time for any reason, including violation of these Terms.

E. RTW is not responsible for the accuracy, reliability, safety, or legality of any user-generated Content.

F. You acknowledge that other users' Content may be inaccurate, offensive, or harmful. You use such Content at your own risk.

11. MODERATION, SUSPENSION, AND TERMINATION

A. RTW reserves the right, in its sole discretion, to:

i. Monitor, review, edit, or remove any Content;

ii. Suspend or terminate any Account for any reason, including breach of these Terms;

iii. Restrict access to features or functionality;

iv. Report illegal activity to law enforcement.

B. Violations that may result in immediate suspension or termination include, but are not limited to: harassment, threats, illegal activity, impersonation, fraud, repeated Terms violations, or misuse of the Broadcast System.

C. We will make reasonable efforts to provide notice before suspension or termination, but we are not obligated to do so.

D. You may terminate your Account at any time by deleting the App and cancelling any subscription.

E. Upon termination, your right to access and use the App immediately ceases. Provisions of these Terms that by their nature should survive termination will continue to apply.

12. PRIVACY AND DATA

A. Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

B. By using the App, you consent to the collection and use of your information as described in our Privacy Policy, including:

i. Location data to provide Heat Map functionality and location-based features;

ii. Usage data to improve the App and provide better services;

iii. Account information to manage your membership and subscriptions.

C. You understand that your approximate location will be visible to other users through the Heat Map when you use the App.

D. You must not share sensitive personal information (financial details, passwords, etc.) through the App's messaging features.

13. INTELLECTUAL PROPERTY

A. The App, including all software, designs, text, graphics, logos, icons, images, audio clips, data compilations, and other content, is owned by RTW or our licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

B. 'Ride The World', 'RTW', the RTW logo, and other marks are trademarks of RTW APP PTY LTD. You may not use these marks without our prior written permission.

C. Subject to your compliance with these Terms, RTW grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on your personal device solely for your personal, non-commercial use.

D. This licence does not grant you any ownership rights in the App or permission to:

i. copy, modify, or create derivative works;

ii. sell, rent, lease, or sublicence;

iii. reverse engineer or decompile;

iv. remove proprietary notices.

14. DISCLAIMERS AND WARRANTIES

THE APP IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

A. To the maximum extent permitted by law, RTW disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation.

B. RTW does not warrant that:

i. The App will meet your requirements or be suitable for your purposes;

ii. The App will be uninterrupted, secure, or error-free;

iii. Information, Content, or routes will be accurate, reliable, or current;

iv. Defects or errors will be corrected;

v. The App is free from viruses or harmful components;

vi. Broadcasts will be delivered, received, or responded to;

vii. Location data or the Heat Map is accurate or reliable;

viii. Other users will behave appropriately or legally.

C. You acknowledge that the App relies on third-party services (cellular networks, GPS, platform providers) which may fail, be interrupted, or be unavailable.

D. RTW does not endorse, warrant, or guarantee any user, Content, ride, route, advice, or information shared through the App.

E. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted, or modified.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTW AND ITS OFFICERS, DIRECTORS,

EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL

NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,

PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF

THE APP.

F. This includes, without limitation, damages for: death, personal injury, property damage, lost profits, lost data, business interruption, or any other loss arising from:

i. Your use of or inability to use the App;

ii. Your participation in rides or motorcycling activities;

iii. Your reliance on information, routes, or Content from the App or other users;

iv. Failure of broadcasts to be delivered, received, or responded to;

v. Inaccuracy of location data or the Heat Map;

vi. Acts or omissions of other users;

vii. Unauthorised access to your Account or data;

viii. Any interruption or cessation of the App;

ix. Any bugs, viruses, or harmful code;

x. Third-party services, networks, or platform failures.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTW'S TOTAL AGGREGATE LIABILITY

FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL

NOT EXCEED THE AMOUNT YOU HAVE PAID TO RTW IN SUBSCRIPTION FEES DURING

THE 12 MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.

A. These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not RTW has been advised of the possibility of such damages.

B. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

16. INDEMNIFICATION

A. You agree to indemnify, defend, and hold harmless RTW and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from or related to:

i. Your use or misuse of the App;

ii. Your violation of these Terms;

iii. Your violation of any law or third-party rights;

iv. Your participation in rides or motorcycling activities;

v. Content you post or share through the App;

vi. Your interactions with other users;

vii. Any injury, death, or damage caused by your actions or omissions.

B. RTW reserves the right to assume exclusive defence and control of any matter subject to indemnification by you, in which case you will cooperate with RTW in asserting any available defences.

17. THIRD-PARTY SERVICES AND PLATFORMS

A. The App may integrate with or link to third-party services, websites, or content. RTW has no control over and assumes no responsibility for such third-party services.

B. Your use of third-party services is governed by their respective terms and policies. You access third-party services at your own risk.

C. The App is distributed through the Apple App Store and Google Play Store. Your use is also subject to Apple's and Google's respective terms of service.

D. RTW is solely responsible for the App. Apple and Google have no obligation to provide maintenance, support, or warranty for the App.

E. Apple and Google are not responsible for any claims relating to the App, including product liability, legal compliance, intellectual property infringement, or consumer protection claims.

18. CHANGES TO THE APP AND TERMS

A. RTW reserves the right to modify, suspend, or discontinue the App or any feature at any time without notice or liability.

B. We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the Effective Date at the top.

C. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

D. If you do not agree to updated Terms, you must stop using the App and cancel any subscription.

19. GOVERNING LAW AND JURISDICTION

A. These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles.

B. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

C. Nothing in these Terms limits RTW's right to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property or confidential information.

20. DISPUTE RESOLUTION

A. Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting RTW at hello@rtwapp.com.

B. We will make reasonable efforts to resolve disputes amicably within 30 days of receiving notice.

C. If informal resolution fails, disputes may proceed to the courts as specified in Section 19.

21. GENERAL PROVISIONS

21.1 Entire Agreement

These Terms, together with our Privacy Policy and any supplemental terms, constitute the entire agreement between you and RTW regarding the App and supersede all prior agreements and understandings.

21.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.

21.3 Waiver

No waiver of any term or condition of these Terms shall constitute a waiver of any other term or condition or any subsequent waiver of the same provision. RTW's failure to enforce any right or provision shall not constitute a waiver of that right or provision.

21.4 Assignment

RTW may assign or transfer these Terms and any rights or obligations hereunder, in whole or in part, without restriction. You may not assign or transfer these Terms or your Account without RTW's prior written consent.

21.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated regarding Apple and Google in Section 17.

21.6 Survival

Sections that by their nature should survive termination of these Terms shall survive, including but not limited to: Sections 4 (Assumption of Risk), 6 (No Duty of Care), 10 (User Content licence), 13 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), 19 (Governing Law), and this Section 21.6.

21.7 Force Majeure

RTW shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemic, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.

21.8 Notices

RTW may provide notices to you via the App, email, or other reasonable means. You must provide notices to RTW in writing to hello@rtwapp.com.

21.9 Interpretation

Section headings are for convenience only and do not affect the interpretation of these Terms. Words such as 'including' and 'such as' are not limiting.

23. ACKNOWLEDGEMENT

BY DOWNLOADING, INSTALLING, OR USING THE RIDE THE WORLD APP, YOU

ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND

BY THESE TERMS AND CONDITIONS.

YOU ACKNOWLEDGE THAT MOTORCYCLING IS DANGEROUS, THAT RTW IS NOT AN

EMERGENCY SERVICE, THAT NO USER OWES ANY DUTY TO ASSIST YOU, AND THAT

YOU USE THE APP ENTIRELY AT YOUR OWN RISK.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
